Order – 2404361-LAW -10-27-16 PM – AEPS Second Amended Final Rulemaking Order for Docket L-2014-2404361 has been published and is effective as of 11/19/2016. There are several changes in the order which will impact the application procedures for Pennsylvania AEPS Certification and Utility RPS reporting going forward. These include:
1. Systems will now receive a generation start date of the application submission date or the interconnection approval date, whichever is later. In the past the application start date was used rather than the application submission date. This change is effective immediately. The requirement for this change can be found in section § 75.63.(h).(i) of the Order.
2. Production estimates will not be accepted for any system installed after 5/18/2017. This requirement can be found in section § 75.63.(g).
3. The schedule for EGS and EDC data submission has been changed to the following:

For EDCs:
(1) First quarter (June, July and August) due by NOVEMBER 4.
(2) Second quarter (September, October and November) due by FEBRUARY 4.
(3) Third quarter (December, January and February) due by MAY 5.
(4) Fourth quarter (March, April and May) due by June 30.

For EGSs:
(1) First quarter (June, July and August) due by the second business day after NOVEMBER 4.
(2) Second quarter (September, October and November) due by the second business day after FEBRUARY 4.
(3) Third quarter (December, January and February) due by the second business day after MAY 5.
(4) Fourth quarter (March, April and May) due by the second business day after June 30.
This change can be found in section § 75.72.(a) and § 75.72.(b).

A number of other changes not listed above have been made as a result of this order and all stakeholders in the Pennsylvania AEPS are encouraged to read the entire Order in order to learn about any changes that may impact them.

These changes are all a result of Docket L-2014-2404361 which has been ongoing since early 2014. Because the docket has provided ample opportunity for public comment and the rules are now final, the AEPS administrator is not authorized to make any changes in these rules or grandfather any systems.
